La nueva Ley de Costas española y las playas de Dénia y Els Poblets
El pasado 25 de julio la Asociación de vecinos La Almadraba de Els Poblets llevó a cabo su Asamblea anual. En ella, entre otros temas, se trató el posible impacto que la aprobación del nuevo Reglamento de la Ley de Costas puede tener sobre las propiedades situadas en primera línea de playa de Els Poblets y de Dénia.

Como saben, la nueva Ley de Costas (aprobada el año pasado) y su nuevo Reglamento (pendiente de aprobación) han aportado algunos cambios a la anterior Ley de 1988.
Vamos a presentarles un pequeño resumen de los pros y los contras que, a nuestro entender, los nuevos cambios pueden significar para nuestra playa.
Cambios que pueden afectar a nuestro tramo de playa
La reforma introduce pequeños CAMBIOS EN LA DELIMITACIÓN DEL DOMINIO PÚBLICO
Para la delimitación del suelo público entre otras alternativas se recurrirá a su estudio geomorfológico y al alcance de las olas en máximos temporales
Este cambio tiene dos caras:
Uno Negativo para los vecinos:
Se requerirá un Estudio geomorfológico del suelo (lo cual Es Negativo porque estamos jugando a la ruleta rusa: no sabemos que suelo hay bajo nuestras casas. Podría ser de origen continental o marino)
Y Otro Positivo para los vecinos:
Se cambia el concepto de alcance de las Olas en los mayores temporales Conforme a criterios técnicos regulados en el Reglamento pendiente de aprobación que dice:
Para fijar el límite hasta donde alcanzan las olas en los mayores temporales conocidos, se consideraran las variaciones del nivel del mar debidas a las mareas y el oleaje. Dicho límite será el alcanzado al menos en 5 ocasiones en un periodo de 5 años (y nunca ha ocurrido en nuestra Bahía).
Respecto a los Paseos marítimos: Se hace coincidir su línea exterior (hacia el mar) con la línea interior de la “ribera del mar”. (Esto parece Positivo aunque pendiente de interpretación). La Asociación quiere que el paseo marítimo transcurra sobre el actual camino que existe en la playa desde el Siglo XVIII al menos.
Respecto a la revisión de los deslindes aprobados y en curso
La reforma abre la posibilidad de revisar los deslindes afectados por la reforma legal.
Este punto es Positivo y negativo.
Es Positivo porque podemos pedir la revisión de nuestro Deslinde en curso desde 1993 pero también es negativo porque deberíamos pagarlo los vecinos y sólo el estudio geomorfológico cuesta entre 60.000 y 100.000 euros, y no hay garantías de resultado).
Solo podrán asumir esta aventura los poderosos.
Otro caso, según nuestro abogado Ortega, para los expropiados que quieran revisar su deslinde: La determinación de la zona marítimo terrestre se hará sobre datos de altura de ola en el mar abierto, sin estudiar hasta dónde alcanza el temporal en la costa.
Respecto a las SERVIDUMBRES Y AFECCIONES LEGALES
Se amplía la posibilidad de realizar obras de consolidación, modernización o mejora en edificios en situación de “fuera de ordenación” en dominio público y zona servidumbre protección. Las obras deben conllevar mejora de “eficiencia energética”.
Esto es Positivo porque abre la permisividad a obras de mantenimiento de las viviendas.
El reglamento no aclara si obras como la simple reparación de un muro o un reforzamiento de pilares vendrán sujetas a intervenciones complementarias y “caras” a fin de presentar la declaración de eficiencia energética.
En lo referente al CAMBIO CLIMÁTICO EN EL LITORAL
Se introduce un Régimen especial para tramos del litoral en riesgo grave de regresión. Si se detecta regresión el estado puede limitar la ocupación, a la vez que introduce Medidas de protección. Esta circunstancia puede ser la Causa de extinción de concesiones.
Este punto tiene una parte muy Negativa porque abre la posibilidad de la retirada estratégica de la Administración. Se pueden lavar las manos cuando quieran si definen la regresión (que hay en todas las playas) como consecuencia del cambio climático.
Además las obras de defensa, en caso de llevarse a cabo, se costearán mediante Contribuciones especiales (según el art.. 87.bis del reglamento): que se refiere obras de protección del dominio público marítimo terrestre que beneficien especialmente al sujeto pasivo del tributo. Y esto Representa Grandes costes.
Este punto, evidentemente, tiene también doble cara:
Es Positivo porque permite obras de protección. Y es Negativo porque las obras las tienen que pagar los vecinos: el coste del proyecto + la obra (y sólo el proyecto puede costar muchos miles de euros y la probabilidad de que lo acepten es escasa).
En lo referente a los cordones dunares (el gran campo de batalla de las playas de arena de Dénia) nuestro abogado D. José Ortega interpreta que son demaniales sólo las dunas que se encuentran en movimiento o evolución, en lugar de serlo todas ellas, como rezaba la antigua redacción (Ley de Costas del 88), un poco de esperanza para las propiedades situadas en primera línea de las playas de Dénia.

Resume of Meeting on Coastal Regulations
Introduction
Town Hall technicians have already
explained some of the changes to the Coastal Act and the new Regulations. We,
the residents and the social part of the problem who are affected by the law,
are influenced less by technical aspects and more so by our personal interests.
Pere Cardona, Vice President of the Ass. de
Vecinos La Almadraba, associated with
the National Platform of People Affected by the Coastal Act (PNALC) stated that
we are not satisfied with either the Reform Act nor the new regulation. The cause
of our discontent is that they have missed an historic opportunity to address
the substantial negative aspects of the previous ‘88 Act and they have not
listened to our arguments. Although we recognize that, in some respects, it may
be that some could benefit from certain aspects.
Let's review briefly where we can apply the
new law to the Bay of Els Poblets and the houses on the 1st line, in terms of ‘positive’
or ‘negative’.

CAUSES
OF REFORM
• Legal uncertainty: Application of the LC ‘88
was very conflicted. Largely was not to apply. With retroactive application, it
solved the problems.
• European Parliament Resolution 2009
(Auken).
• "Unique" problems that require
unique solutions.
• Problems with concessions that became
irrelevant from 2018
• Problem of Cultural Interest.
• Need to strike a balance between economic
development and environmental protection.
• Problems of climate change.
DEFINITION
OF MARITIME LAND IN THE PUBLIC DOMAIN (foundation for its definition)
• Soil geomorphological study (Negative: Type of ground beneath our homes unknown)
• Greater Storm Waves: Under regulated
technical criteria** proposed regulation. The
regulation states:
Article
3 of Regulation, "Real maritime-terrestrial
public domain by determining the Constitution" says State assets are
maritime-terrestrial public domain, under the provisions of Article 132.2 of the Constitution and 3 of Act 22 / 1988, July
28: 1. The sea shore and estuaries, including: a) The sea-land or the line
between high tide and or the limit to where the waves reach in the worse known
storms, according to technical criteria set out in Article 4 or when it exceeds
the maximum line equinoctial tide.
Article
4 of Regulation, "Technical Criteria** for determining the maritime zone and the
beach," which says: In determining the maritime zone and the beach,
according to the definitions contained in the preceding article, the following
criteria will be considered: a) To set the limit to where the waves reach during
the largest known storms, changes in sea level due to tides and waves are considered. (Positive: This
limit must be reached at least 5 times over a period of 5 years. It has never
happened in Els Poblets Bay) En Verde
• Land flooded artificially and unnavigable
(salt flats) are excluded.
• Terrestrial Maritime Developments
(Benalmádena / / Empuriabrava): residential core with "navigable road
system" built with artificial flooding of land. Supports private enclaves
in the public domain. -Disp. ad. 10 -
• Boardwalks: Should match the outside
(seaward) with the inner line of the "sea shore". (Positive: Although interpretation pending). The
Association wants the boardwalk formed on the current path that has existed on
the beach since the eighteenth century at least (attached pictures and photographs
of the nineteen 60’s to 70’s).
• Dunes: Only necessary to ensure the
stability of the beach and coast defence.
DEMARCATIONS
Obligation to review the boundaries
affected by the legal reform. (Positive and negative. Positive because
we can request a review of our ongoing demarcation line since 1993 but negative because neighbours should pay geomorphological study
which will cost between 60,000 and 100,000 euros, and there are no guarantees
of outcome).
Only the rich and powerful can undertake

Street flooding
As we approach the 12th October, it is correct that we remember the devastation caused by the waters of the Riu Girona. We are truly aware of the damage that water can cause and the fear that accompanies the knowledge that, any moment soon, your garden, car and home will be flooded.
For the residents in Partida Sorts de la Mar, Carrers 10, 11 and 12, flooding started in the early hours of 12th October, long before the River burst its banks. At 1am gardens were flooded, by 3am water was entering the first houses and by 8 am several more were flooded. By 11 am, at least 5 houses were flooded and yet, the river water had not reached this area to augment the rain water that was continuing to rise.
Although some 16 properties and gardens were eventually flooded, along with the loss of several cars, things may have been less severe with better urban planning and improved drainage in those roads.
It is sad to report, that to this day, almost 6 years later, 6 or 7 properties continue to be flooded every time that there is a heavy rainfall and although some residents have built temporary water prevention barriers across their doorways, their gardens and other houses suffer flooding and/or extreme water damage. For the unknowing citizen that parks his car in the ’wrong place’, the car is likely to be submerged and destroyed, as happened during the last episode at the end of August.
Carrer 12 was urbanised some time before the grand flood and the Town Hall has improved the drainage and sewerage. A water pumping station has been installed and Carrer 10 was urbanised 3 years ago, but still these same three streets are being flooded. On each and every occasion, the Association of Neighbours the Almadraba of Els Poblets has registered letters to the Mayor, as President of the Town Hall, to rectify the problems so that the residents can sleep peacefully.
During the evening of 28th August 2013, these streets were flooded once more. During the early hours of 30th August, yet again gardens and homes were flooded. On both occasions a letter was sent to the Mayor, pleading with him to find a definitive solution to the problem of flooding in this area. To date, neither of the letters has received a reply.
On Wednesday, 11th September, the Secretary of the Association had an appointment with the Town Hall engineer, Rafael, so that an evening meeting could be arranged for all of the neighbours of the affected area to attend. As he was not able to arrange this type of meeting without the authority of the Mayor, the Secretary agreed that Rafael would discuss it with the Mayor and that he, Rafael, would telephone the Secretary before the weekend. The Secretary is still waiting to receive the telephone call!
As has been pointed out, Autumn and Winter are still ahead and the residents of Partida Sorts de la Mar, Carrers 10, 11 and 12 continue to live with the same apprehensions, fears and sensations that they had on 12th October 2007.
This is not just or fair and certainly not good for their health!! The reasons for the problems are irrelevant to those that are suffering, they are not interested. It is for the Town Hall to rectify the problem, that is, after all, what those residents pay their taxes for. Desperation is hanging over their heads.
